i have an 18 year old in high school who is sick and have pediatric brain injury from Lead Poisoning when she?

was 18 months. We miss our court date for Child Support. The letter went to VA instead of NC where we live. This was told by a Child Support worker. The judge of Child Support close our case because of miss school and low grades. She has never quit school. We went thought 3 years of abuse. The don’t know the whole story. Child Support told me that i got to get an attorney although i was not given the chance to explain what has been going on. We don’t have money. I call Legal Aide they said they don’t help with Child Support issues.
How can I get a court date or help on how to get her child support started again? Her dad is not in her life nor does he want to be.

    Damn sorry to hear that. Im not really experienced with these kinds of stuff but I will tell you what I know. . .

    I dont think your child can have Child support because she is 18, magic number 18. What you need to do is apply for Medicaid. . . Or

    Send in complaints to the state on how your child was abused wether it be from teachers, education, kids, treatment and so on.

    I know this isnt much help.

    You’ll probably need that attorney because of the mix up and the fact that a judgment has been rendered. You should go to family services of the state in which you live and apply for aid. You should gather your child’s medical records and apply for SSI. Try to find an attorney to represent your child for the administrative court hearing for SSI. They’re out there. Ask that attorney about any other action you can take to insure your child’s future. Sorry I don’t really have much of an answer.

    There isn’t a judge of Child Support. There is a judge in domestic relations ourt which I assume this is. Was her father filing to have his support stopped because she is 18? By her missing school i can see the judge ruling that she was not going to school and if not going to school, she is 18. It would be up to you to show she has a brain injury and is not capable of taking care of herself. That should have gone on her record when you first got support. If your support was not coming from the father but you were receiving money for her support from Children’s Services and it was terminated, then it may be a bit harder. You do need to go to court. If you can’t get an attorney (and just realize that if you don’t get an attorney you may get no money. I f you get an attorney you may get money and can then afford to pay him). But you need to show the court with the attorney that she is not going to be a competent adult when she graduates, if she can graduate. Is she classed as disabled? If not, you should try to get her classed as disabled so the support would continue.

    You should be able to get this opened back up since the letter went to the wrong state and you did not get notice. However, you have notice now and so you have limited time in which to appeal and open this back up. It would be very hard to do this if you were very familiar with laws in your state and had a good command of English. You don’t so you do need help. If Children’s suport won’t help you, how about seeing about a child advocate? You could try to find out from Children’s Services how to get a child advocate,, but what you really need is an attorney. If you have had an attorney in the past to get the support, go to the same one. You could call and make an appointment and make sure he/she will talk to you for free and only charge if he/she can take the case. Then try to arrange for money to come from any money you receive to a maximum amount. Contingency is where attorney takes 1/3 of it and you receive 2/3 and that might be better than now as you receive nothing now. Also, try for longer than just high school as your child is disabled.

    Do you qualify for Medicid and Supplemental – I can’t recall the initials ISS or whatever it is?

    You did much better presenting your problem this time than the last time I saw your question. You were much more clear with what had happened and it was easier to understand. Good job.

    I wish you good luck, but you need to do something to get this and if you can’t go to court and get it going on your own by seeing a clerk of court in the court to let them know you didn’t get notice and in opening it back up to get a real hearing, you will need to get an attorney to get help, even if the attorney takes a portion of the support money.
